    Case received at Texas Service Center - july 2nd 2007. (monday of the big chaos)...had mailed the case on Sat(before chaotic monday) thru DHL overnight
    Case transfered to NBC - Dec 2nd 2007 (me & spouse)
    Case status changed to interview - Dec 4th 2007 (me & spouse)
    Preliminary process complete USPS mail - Dec 4th 2007 (me & spouse)
    Case pending at the USCIS office transferred to email - 02/12/2009 (me & spouse)
    RFE - 02/13/2009 (me & spouse)
    Soft LUD - 02/17/2009 <------ (me & spouse) (here is where i think the RFE notices are being printed today and will be mailed - we should probably get them by this Friday 2/20)

    assumption 1 - Being that both me & spouse received RFE, i am thinking it mostly is either health records, finger prints, photo graphs, or signatures (we had g-28 to let our attorney sign on behalf of us and they (uscis) might need original signatures)

    assumption 2 - Worst of all because the status changed to RFE on 2/13 and we might not get the notices till (02/20) we lose a whole week just waiting on the notices and we will have mere 3 weeks to respond back

    likely fact - for whatever reason we are very few folks who are in this boat with same pattern and have to stick together to see where we will end with this

    I believe pre adjudicated means, most of the processing is done, and waiting for the visa number availability.

    Nothing will happen for you on the info pass, hopefully you will come back with a good news.

    please update us after the info pass.

    Also if you could update your profile (priority date etc) it would be good for the people who are following this thread.

    question 1) did both you and your spouse's I485 cases receive the "pending at the location it was transfered to"?
    question 2) did both you and your spouses I485 cases receive RFE?
    question 3) did both you and your spouses case have an LUD after RFE?

    have you guys received the RFE notices and if yes, what is USCIS asking

    IN RESPONSE to AKRED: My dads priority date is july 2005, so how does that give me amnesty...he applied under PERM!!! Btw if you do not support DREAM ACT than you shouldn't be on this forum...

    asindu...sorry to hear that man...can you post the link of this act or an analysis of it. I bet a lot of people will support it if they see a credible evidence that it will help the legal immigrant community. There seems to be a widespread belief that this focuses on the illegal community.

    There is a lot of bad rap that we the legal immigrants have to face because of the rampant illegal immigrant problem, most of the folks here gets peeved off if an act has a bias towards that.

    ok - it didnot leave on my own but got laid off. so i had no choice and i got laid off just 14 days before 180 day mark so my petitioner employer will thus not revoke 1-140

    but,

    i started the new permanent and smilar job 11 calender days before 180 days and now if I file AC-21, this will be a major issue now??

    SO, in that case, should I just sit tight and do nothing with AC-21 filing?

    I am very nervous now, please advise

    We appreciate ur apprehension, but please do not sow unnecessary seeds of doubt. As it is, making most legal immigrants take part in this struggle, is like milking a male buffalo.

    If you feel that these efforts are being wasted, then you are free to watch from the sidelines. Pls do not take this as a personal attack on u, but you are one of many many such immigrants who are sitting on this fence.

    Regarding the professionalism shown by people here, i would really ask you not to attack without fully understanding the efforts taken by people who have formed this group. People have been travelling back and forth to DC to try and establish a lobbyist firm. Instead of criticizing please do your part by helping and doing something.

    People have been approaching their communities for help, researching pro-immigrant organizations and working with them to get support. Even arranging for news sites to do something for us.

    Please, we urge you not to sow seeds of doubt.
    Go read the posts on the other website, and you will see how important it was to counter this guy's posts that were raising basic doubts about IV.
    To have prompt responses is extremely important! If you brush aside negative comments from 'male buffalos' and not counter them - we will never be able to get them into action!
    Anyway, however clumsy my efforts, I could not just sit and watch & not try to get doubts addressed.

    12. Question(08/03/10): It has taken several years for me to receive the I-485 approval yesterday based on the employment-based petition filed by my employer. I have never changed employer. Neither have I invoked AC 21 change of employment. Since the 485 is approved, I am seeking new employment and started sending out employment applications to various employers. Is there any law that forces me to work for the green card sponsoring employer even after the green card is approved?

    Answer: The green card employment is "permanent" employment. "Permanent" means the employment term is not temporary and must be for a period of "indefinite" duration. Inasmuch as there is no ending date, it can be considered a permanent terms of employment. The employer sponsed employment based immigration requires both the employer and employee to retain "intent" to offer such permanent employment and accept such permanent employment on or before the I-485 is approved. If the employer does not maintain such "intent" and file a labor certification and I-140 petition, It can be construed a fraud. If the employee does not have such "intent" and sign the labor certification application and and file I-485 application based on the employer-sponsored I-140 petition, it can also be considered a fraud. The issue is "intent" which is a mental state as judged from the actions of the employer or employee. AC-21 portability of approved I-140 petition changed the picture and both the employer and employee are freed from such obligation if two conditions are met. One is that until AC-21 is invoked, the employer and employee retain such intent. Practically, in the context of AC-21, such oblication is limited until the alien invokes the AC-21 change of employment after 180 days of filing of I-485 application in similar or same occupational classification. There is a grey area where the alien does not invoke AC-21 and change of employment. In such context, it may be assumed that both the employer and the employee retain such intent at the time I-485 is approved. In old days, the legacy INS was active in initiating a revocation of green card proceeding before the immigration courts to stip off the approved green card and launch a deportation proceeding based either on the ground that there was a fraud on the parties or the INS approved the I-485 application without the knowledge of such fact of ill-conceived intent of the parties. The theory of the law is that "had the agency known the true facts." the agency would not have approved the employment-based I-485 because the I-485 could have been ineligible without such intent. Intent is proven in most cases by the circumstantial evidence since no one can go into the state of mind of other person. The evidence they used to use was the evidence of search of another employment immediately before or after I-485 was approved. For the reasons, even though there is no fixed period of time for a new green card holder to work for the sponsoring employer, legal counsels advised the employees not to send out employment application in writing to other employers immediately prior to the approval of I-485 application or at least for certain period of time like two months not to change employment, because such behavior can be construed as relection of the true state of mind and intent of the employee not to work for the sponsoring employer before or on the date of approval of I-485 application owing to short period of time that lapsed when they changed employment. This problem used to pop up during the naturalization proceeding when the agency learned that the alien changed employment immediately before or after the green card is granted. The foregoing inent issue can be overridden when the alien left the job because of employer's decision to terminate the employment or because of change of circumstances which are beyond the control of the parties such as slow-down of business and layoffs. Again AC-21 affected this issue, and it appears that the agency may no longer actively look for this issue. But theoretically, the issue still exists and a law is a law. Accordingly, there is always a potential risk of this issue popping up after green card is approved, especially when there is a grudged sponsoring employer who obtained and possessed such adverse evidence and contact the agency to revoke the green card. Just beware.

    Guys - I asked my lawyer about the predicted time frame of my case which is EB3 ROW priority date of October 2005. I asked specifically if my case would be approved in a matter of months or years. They said that my case would most likely take years!

    I don't really understand how the process works - how could it be years when my priority date is only 4 months away. Does anyone have any explanation why this would be the case.

    This lawyer has been great for me and I trust what they say but I am not sure about the prediction - if anyone could shed any light on this I would be so grateful.

    In mycase I went to the local USCIS office and the IO there sent an e-mail as well but no news on my FP yet. Try your luck.

    gc4me can you please send me the phone number and combination of codes so that I can get them to send my FP notice, i am July 2nd filer as well.

    Thanks Sheela. Was that visit to home, a part of your employer audit as well as it was mentioned by bujjigadu123 or something else?
    Not sure whether you got a chance to ask the officer about the reason for this visit? Was it a part of random check or any investigation on fund transfers or any other program etc?

    Now, I think it is a random check and nothing like 'employer audit'. I never asked him -at that time I thought it was a part of background check.

    I believe they are always doing these checks probability could be 1/100,000 although i have no idea at the frequency.

    Yes you are right, there is bound to have EAD flood in market, with spouses of hi-tech worker will come to market to search hi-tech job with spouse phone support. I have seen such cases countless times in past few years and yes they will be in future without exception. However, matter of fact, these fresh EAD (previous H4) don't get the dream job in first attempt, it takes good 2 year to find a similar job that H1b hitech worker does.
    But thats the realty of market, every year new jobs are added and every year new job seekers join the crowd.
    On the otherside, a hitech worker is suppose to always learning something new and getting his/her position more stronger everyday, its a knowledge market, whoever knows more gets better $$. With my 7yr US exp and total 10 yrs CS exp I have no scare that any single fresh EAD will come close to me. A senior is always a senior no matter which field you talk.

    When is this name check reform getting implemented. Why is is so difficult to implement ?

    Because the USCIS did not implement name check procedures properly in the first place - they are not required by law and are not codified in the regulations, the USCIS can implement new procedures simply by issuing inter-office memorandum. One day is enough to do this. I anticipate this may happen within the next two months, more likely early next year. But one can never predict the USCIS, it does not have logical behavior :)

    What are your inputs on Maternity Advantage, I got this information from Pregnancy Insurance.org

    Also please provide me info, if any, on hospitals which provides maternity insurance.
    ** for pregnant with individual health insurance which does not cover maternity.

    Based on my experience , Depending on type of delivery hospital bill for delivery can vary from 10,000 to 15,000 for Mom and 2000-3000 for new baby.
    And prenatal bill around 4000 ( excluding all UltraSounds) One UltraSound Cost around 400-500 $.

    So, If you don't have insurance total bill my about around 25,000.

    Depending how far in pregnancy you are, One of my friend was in same situation he decided to take his wife to home country.
    I am not discouraging you, But keep all this in mind before you take the decision.
    I Hope and pray that you can get some kind of insurence

    But I have almost finalized to get into a group insurance.

    Are you sure he is not going to mess up ur case because u filed using a different law firm against his wishes.

    You only can answer the above question. If u think there is a possibilty that he will mess it up, Dont go with a different law firm.

    Talk to him and see what he needs.

    I do have copy of labor approval but I donot have copy of job description that they filed for labor. I also have copy of 140 approval.

    I don't think I can get letters from HR (there are couple of people who handles everything from getting timesheets to posting payslips) as they very loyal to my employer.

    Then I guess my only options are
    - give it a try to file through another attorney with paystubs and without employer letter.
    - forget about $5000 and proceed.

    If it is of any consolation, though not required, I did submit employment letter along with her I485 from my wife's company which states her current salary and that employer is willing to provide employment till her H1B approval expires.

    It means, if at all they have any doubts, they may issue RFE, but if you have a good relationship in responding to those RFEs using company letters etc, there is no problem. Good relation means, employer has to suppprt you always in case of any RFE, thats it. He needs stand on your side. Then there is no problem. But if he won't stand on your side, then it is a problem. So, thats why relation with employer is very important when on H1 or EB.
