Hi
I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....
Keep all email correspondences....You can infact make him pay dearly for harasement...

You're right, the point I was making is the real intention of these Senators...When you want to scr.ew somebody you ask questions that are hard and mostly unanswerable....Take this example, Look at the requirement that Hyderabad Consulate has put up for H1B Visa Stamping, it sounds like they are saying don't you dare!!!Find the pdf with the questions he asked and compare to the answers they gave.

I think it was Zoe lofgren who sent a letter with very pointed questions to USCIS. I don't believe they made public their answer or if they answered it at all; and instead of fighting with Senator they reversed course and opened up the visa dates again. (A big part of me thinks that it was pure financial decision. USCIS was going to have fee increase and they realized that they would lose a lot of money but after they did their analysis; they realized their breakeven point was each candidate renewing ead/ap once and they would break even. They would even come out further ahead by allowing the applications because people would be renewing at least three times whereas in old fee structure it was only built in for one renewal).

IV is in no way in the business of contributing to any election campaign. IV has hired a well-known reputed Public affairs firm who can voice our concerns in the legislative circles of this country so that they can be taken care of and this is perfectly legal in this U.S.A. Lobbying is just another word to represent put your issues in front of lawmakers. Now, to have a professional & effective representation one needs to hire a Professional of repute which is what IV has done by hiring QGA.

class action lawsuit?? for using up too many visa's too fast?
wow. for once (& only once) I feel sad for USCIS. They are damned if they do, and damned if they dont. Usually all talk of class action lawsuits have been for visa numbers that they wasted by approving too slowly. Now another one for going too fast... :D
Seriously, I would be very very happy they are for a change working really fast so no wastage of numbers this time around. common guys don't you think is it good for us over all. may be we will not see some movement for some time but at least you know that we are not suffering because of USCIS's inefficiency.

being on H4 for the past 4yrs scenario...?
what are the chances of the H1b approval being 4yrs on h4...? as in how strong is the resume being..?
will they question about the past 2 yrs of H1 status...asking cos I dint work for a while as I dint get a project..?
converting to H1 in such a situation, will this be risky and asking for trouble..?

My current working company - EB2- August 2002 - 140 is under processing....
(receipt date for 140 is October 2007)
(thanks to labor backlog center :mad: got stuck in backlog center for 5 years)
With my friend's company - EB3 - April 2004 - 140 is under processing....
(receipt date for 140 is July 2007) 485, EAD, AP filed and got them also.
What all the options I have now? Which one will be better assuming both 140 gets approved.

I remember I read this somewhere (on one of the forum threads on IV) - that the only dates movement (if any) for EB-2 (India) will be only during Oct'07 (when the new financial year begins).
Until then, I guess there is no point in checking these Visa Bulletins; Only difference is when one of the pro-immigrant Bills in the Senate or House get passed.
For now, best strategy is to follow IV Core's directives - they have always been on top of things (going by the past one year or so), and seem to know more than most of us.

Yes, DREAM Act should not discriminate documented children against the undocumented ones. IV should support amending the DREAM act to include documented children too, since IV is fighting for the issues of legals, law-abiding people like us.

I understand your point about having another rally. Make no mistake - IV core has no problems with planning and conducting another rally. So it's not a big issue to get them to agree. I can push IV core, and get another rally. Bigger issue is how many are going to turn up? If it's just 100-200 of us same-old folks, there is no point.
Last year when we were bouyed by the success of July VB reversal, it was estimated that at least 10,000 would turn up. But, only 2000 did. I don't know how many will, if we hold another few months from now?
IV can sponsor more ACTION (items). But what's point, if there is not enough participation? First step is the community needs to step up and make existing action items such as FOIA requests for backlog numbers, AC21 action items successful. This will motivate IV to launch more action items. No organization would want to be seen running too many campaigns with liitle or no community participation.
We need the IV core team and the administrator to guide some big rally's. Guys nothing will happen until we are bold about our intentions.
I noticed everyone comes up with their different ideas, but no one works to implement it. We need to stand together and do something big, when was the last time we had a big rally?
And how many people actually showed up? Desi's wants everything fast and free, the problem is lately IV thinks too much and has less of ACTION

I am traveling this month end to India via Frankfurt. I am on AP. I checked with German consulate in US and officer told me we need transit visa both ways (going and coming back). there are no exceptions. He confirmed the same twice when I went in person to get Transit visa.
I would rather listen to German consulate office rather than interpreting stupid sentences on German consulate web site. So please do get Transit visa with 2 entries.

I am wondering everybody here is throwing stones at small consulting companies, I wonder how these people came to US surely somebody did there H1? right? People are working in big companies HP/Oracle/SAP bla bla.. but I'm sure they are not the ones who brought you guys here. Also the day they'll get their green cards each of these people are going to open similar companies and do the same thing. This is amazing how people forget their past and forget the people who brought them here...I will call you guys thankless....

Dont let people come here and not pay them / treat them as slaves on contract etc. Look at all the postings (go to murthy's web site--you will see many) Employer not paying, etc etc. In such case whats difference between an illegal hotel worker and these mistreated H1bs. I stay in an apartment OK. One day my neighbour (living downstairs) was crying with his wife and a small kid. You want to know the reason--NO PAY FOR 2 MONTHS!!!!. All his hard earned money was finished paying rent, OK and his kid was sick. No money, nobody to ask. His contractor said WAIT, WAIT and nothing else. Having personally seen this situation, I am a little concerned. Why would you be concerned in asking infosys to disclose the usage of H1bs procurred by them?? If its used properly there shouldn't be any issue. Now how microsoft uses the H1b is more transparent. How many of u working for microsoft have had any issues???
