* AILA has reported the DOS advised AILA that "thanks? to" the decrease in demand for EB visa numbers from USCIS I-485 cases and 245(i) labor cases still being held in the Department of Labor, the visa number would progress forward as follows:
o Worldwide EB-1 and EB-2: There will be no cut-off date for the these categories.
o Worldwide EB-3: Unlike the DOS previous prediction that the large number of 245(i) filings would be filed during March and April 2001 and it would result in a surge of EB-3 number demand and would limit movement of the cut-off date, 245(i) cases still remain at the DOL and therefore there will be movement in EB-3 visa numbers.
o India EB-1 and EB-2: It will continue a rapid movement for the next several months.
o India EB-3: It will move ahead but may become limited down the road.
o China EB-1 and EB-2: It will continue a rapid movement for the next several months.
o China EB-3: It will stay at the Worldwide date.

Pappu, special thanks for researching this topic, and posting updates regularly.
Last week I too consulted a high profile (about $200 per 15 minutes... you should be able to guess, I am not sure I am alowed to mention the name) lawyer to discuss this issue. To give you a brief background, my lawyer did not include the Employment Verification letter
1) He told me that he would re-submit the AOS. The comparison to the medical clearance requirement, according to him, was pointless, as they are two different things. If USCIS issues a statement they will not reject solely based on the EVL, then we can assume that is the truth. Their statement on Medical clearance cannot be interpreted to say they won't reject on the basis of another missing requirement, say the EVL.
2) Filing two AOS packets can indeed also cause confusion, but it is a smaller risk according to him, and should be mitigated by a covering letter that says you are re-submitting to provide the XYZ document that was missed from the first packet.
Based on this info, I have asked my lawyer to get a confirmation from the USCIS on the document that he missed in my case-- the EVL. If USCIS okays that, we do not resubmit. If they don't do that within a week, I will try to re-submit... not going to be easy considering my lawyer may not be in agreement... but that is what would be the correct way out of this, according to the second opinion I got last week.

just a question on #2 above - if you are filing second AOS with EVL, why not just withdraw the first AOS once you get the receipt? Wouldn't this be safer?

There are 37275 applications with PD of 2004 or earlier. Can we make an assumption that about 20 to 30% of these would try to port once economy turns around in the next 18 to 24 months? How will this impact wait time for a EB2 with PD Jan 2006?
I am really disappointed in the info provided via the foia effort. It told me that there are only 4118 applications before me. 4118 vs 28074. Worst kind of sick joke.
Based on the PD on my 140 Approval Notice (May-2004) there are 28074 applications before me. This is the correct date.

I do not know how my application was counted when the data was put together.

i support any action.. but writing to Uscis will help only if your interpretation of law (or lack of law) on spill over is correct. Shouldnt this be confirmed first?

Vonage was just responding to the competition.
Lingo has a world plan which included unlimited calling to 30 countries( India not included)
India calls were just 2 cents per minute. I switched to Lingo from Vonage 2 months back. Sensing this mass exodus, vonage came up with an even more aggressive plan.
Competition is good !
How is your experience with Lingo customer service. Last year, I tried to switch to Lingo and the lady at customer service is very rude. She is so tired to answer questions and asked me to get all from website. I stopped switching to them.

If 5882 is resurrected and debated, we should definitely do something - anything that time. But if not, and this (lets make calls! lets write! lets send flowers!) is another of lets do it because 10 people think its a great idea, not a coordinated campaign coming from IV core, count me out.
I've always made the calls, contributed money, etc, but I'm getting a bit tired of this "charge of the light brigade" mentality. If there is zero chance of something happening, but everyone is told to make calls, contribute and after all the rah, rah, sis, boob, ba everything fizzles out, and it happens 4 times a year, the mood sours.
Doesn't mean I recommend switching off the whole process and giving up. But the best way to beat apathy and cynicism to make sure we pick our fights. Fight only the winnable ones, and keep the powder dry at other times.
Just my opinion.

Any body know why there are 3341 cases in March 2005 in EB2 I category, is this about the time PERM came?With out quarterly spill over bulletin is going to get stuck in March 2005 till the end of the USCIS financial year.
Yes, PERM was introduced on 28th Mar'05. I guess the high number of EB-2s was due to employers rushing to file under the old system.

To send the inquiry thru your congressmen and Senators, you need your A numbers and SSNs too, along with your country of origin, DOB, profession, employer and all nine yards. This is a official faxed or mailed request which shd have date, sign and marked to your congressmen's office. Part of Federal privacy rule.

The best thing to happen to immigration lawyers is H1 quota increase. That starts a whole chain of events that will generate revenue for them until the guy on H1 is citizen.
Getting people GC faster could only serve the revenue generated from filing I-485, but then retrogression does not eliminate it, it only delays it.
Lawyers hired by my company dont seem to care much about retrogression(they sure do pretend). they would work in the best interest of WHOEVER PAYS THEM.
In general however, they would love:
1. H1 quota increase(irrelevant to us).
2. Family immigration(irrelevant to us).
3. Faster EB GC(relevant to us but not a high priority for them).
I was relying on AILA all along thinking that they will work for themselves and in turn it will help us but it shows from 1932 that by joining Quota raise of H1, they torpedoed the whole thing.

Do things in this order -
1. Find a job first.
2. Secure a good apartment at new job's location.
3. If you need a better car buy one right now.
4. Get some credit cards.
5. Let your home go to foreclosure.
It is a financial decision. Every once in a while, most of us go to different stores and ask them to match the price for the item that we had purchased earlier. If they do not match the price then we return that item. Don't we? Do not get sentimental. Just walk off! Your credit history would get screwed but if you plan it the way I said above, you will be fine. Good luck.
And it won't affect your GC.

Good job slumdogs. You are becoming a puppet of anti-immigrants. Today they are using you to throw your L1 brothers out. Tomorrow they will throw you out. There is fraud in H1 too. No visa is perfect. Just like no American citizen is perfect. 1 in 100 citizen has gone to jail.

people who try to make quick money in couple of years by investing in house is ............... It is better to go and try it out in Las Vegas how lucky you are in making money instead of trying it out in real estate market with the span of 1-2 years in mind.
Even if someone wants to make quick money, here are the few tips. Also these tips are tips and not guidelines.
0. Know your limits. If you earn 100K, your buying power by thumb rule is 300K. So on saferside start searching with the range of 250K-260K. VERY IMPORTANT RULE.
1. Check the rental cost where you live. Example if 2br apt is 1200, then try to limit your mortgage, taxes etc within 1500 assuming you buy at least 3br house.
2. Reverse calulate the down paymet you have to put by subsituting your monthly payment ( apartment rental cost in your area + house tax + $300). Calculate the % of down payment from the above formula.
If the down payment comes to 10-15%, then it is worth buying than renting in your area. If the down payment is above that, then try to meet it. In worst case put 20-30% down payment to keep your mortgage payment lower.
Again, the above information is based on my house search and analysis. Others might have different opinion. Please take it if it is worth for you otherwise just ignore it.

I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.
There is no number to call here to check on status - I have been sending emails to mumbaiNIV@state.gov but have not received any response from them yet. Not really a surprise. If anyone tries the number above and gets some response please let the rest of us know.

FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.
I have similar experience. I moved to sunrocket (which is now teleblend) from vonage. I pay half of what I used to pay vonage for same services/usage.
currently teleblend offers $50 unlimited india calling + ofcourse US+canada unlimited. However as now vonage has come up with $25 world plan, I am sure teleblend would come up with something similar soon... may be $20 world plan or so. As they always price it below vonage. Let's hope! competition is good for consumer.
