It is not good disparaging the countries needing TV by calling them idiotic and asking for boycott etc. Please know that you are living in a country (USA) which is far worse than those "idiotic" countries in this respect since 2003. US needs C1 visa for transiting through its airports even when you have a valid VISA stamp in your passport to a destination country and you need to fill eqaully gruelling application (DS 156). Also you need to carry documents for travel purposes and financial support.

hi,
My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.
Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.
I need EAD now. What should i do?
I called the USCIS and they said that it is out of processing time and filed a service request.
All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?
I am confused , what am i supposed to do?

So, their fight is primarily geared in support of undocumented (read "Illegal") people.
We already have enough problems educating common people and lawmakers about the differences between legal and illegal immigrants. Let us not add fuel to the fire ourselves.
Thats just my personal opinion.

I agree with focusing on the Logfren bills, but the flower campaign might not work. Last year it was a combination of pressure on the lawmakers, USCIS and DOS by IV, AILA and a other groups. the flower campaign highlighted the issue to the public and gave us wide exposure...last years fiasco did not require a law change. In our case the clear cut issue is to make recapture happen. The only why for it to happen is by pressuring the lawmakers to take a yes or no decision.
I think we should all request our employers to call the lawmakers, individual calls will help but we need to take it to the next level as the window is very short.
Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..

I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.

Agreed. But EAD doesn�t apply to EB based immigrants alone. There are hundreds of thousands of family based immigrants who use EAD until their status gets adjusted and I-140/AC21/180 days etc. are not applicable to them. Same applies to the spouses of EB applicants. In such cases it�s a waste of time/money for the company to consult with the legal department.

You very well know that GC comes when the time is ripe, so you should really enjoy your sweet time instead of lurking on these forums.

Gandhi requested the nation to start burning the cloths that were made in Great Britain, most of the people felt that it was inappropriate. What can you achieve by burning your own cloths? But later on an entire nation saw the power behind civil disobedience. Even the people who were worst affected by Swadesi Movement (the cloth mill workers of Britain: who lost their jobs-bread-butter because of less demand) realized that this was done to support a just cause.
I would like to quote a poem by C. Rajagopalachari:

va_dude, your concerns are understandable. This issue is real and some IV members got affected by this and came forward to provide some more info. pd_recapturing collected that info. A bunch of volunteers are working in the background to move this forward with concrete proof. In the meantime its important to keep sending letters so they know the concern its raising.

Just Now, I received a call from congresswomen staff. She was able to get some standard response from NSC via congrees inquiry cell at NSC[she read for me]. Still 26000 application are pending NSC prior to July 17th filer. I asked again and again same question, How they can enter data for Aug first week before July 2nd. What about FIFO? She was repeating again and again what response she got from USCIS. I was able to get I-765 # from her. I asked her how come 765 (LIN#) is possible without 485 data[she don't understand inter-dependency of application]. Stange but something is better than nothing. I will write again for FIFO. I don't want USCIS actions go unnoticed. I will do my part.
I am happy congresswomen staff did some inquiry. I will post when i received copy of USCIS official reponse to congresswomen by post/email.

I have a copy of my approved I-140, and the only number I see on it is Receipt Number at the top left side of the notice. It reads like LIN-xx-xxx-xxxxx.
Is this the A# number you are referring to?
That is your receipt number. In my case, the A# is in the box that has the name of the beneficiary.

Here is a summary of the bills, their bill numbers and the Sections:

-High-tech workers who have worked in the U.S. for 3 years would be allowed to adjust to permanent resident status without regard to the annual employment-based immigrant visa cap of 140,000.
-The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.
McCain/Kennedy Bill (Sections 601 and 602 of S. 1033)
-Increases quota on EB immigrants to 290,000 to alleviate retrogression
-Recapture unused visas between 2001 and 2005
-Increase the per country limit from 7% to 10%
Cornyn/Kyle Bill (Sections 1001 and 1002 of S. 1438)
-Recapture of the unused visas between 2001 through 2005
-Removal of diversity visa and reallocation of these. Since this is mentioned under EB, the implication seems to be reallocation to EB but am not sure.
-Increase of the country limit from 7% to 10%
It is understood that there would be a merging of these to make the final comprehensive immigration bill

I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.
This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.
Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

Mamit: Take a deeeeeeeeep breath! Good for you that you are dealing with this right at the start of your career. Get all the bad stuff out upfront. I have a family and life to take care of in the US and I am stuck in this crap since Jan 7th. It is extremely hard and frustrating - but there is simply nothing that you can do about it right now. So, relax and wait it out.
The PIMS stuff is all messed up and iff you have a common name, your lottery for "Security Clearance" may have come. That would significantly add time to it. If this is your first stamping - the chances of rigorous checking is higher - although that is not always the case.
It is easier said than done - but seriously, let the life take its own course, this too shall pass and soon!

I did post a question on the other thread today about the Advance Parole (AP). Did you know about it when you left for Delhi? To be honest, I didn't. In fact, for two months I wasn't even going online to research about why I was stuck here, and was hoping my visa was just around the corners. I have posted a question on that thread asking if it was possible to obtain an AP while in India. If it is possible then I can go to Delhi, get my unstamped passport (they did say I could do that when I interviewed with them), and go to US. The PIMS stuff is all messed up and iff you have a common name, your lottery for "Security Clearance" may have come. That would significantly add time to it. If this is your first stamping - the chances of rigorous checking is higher - although that is not always the case.
It is easier said than done - but seriously, let the life take its own course, this too shall pass and soon!

Calabor2001, thanks for the moral support and I am sorry to learn about your situation too which, like mine, seems to have become quite an ordeal.
I did post a question on the other thread today about the Advance Parole (AP). Did you know about it when you left for Delhi? To be honest, I didn't. In fact, for two months I wasn't even going online to research about why I was stuck here, and was hoping my visa was just around the corners. I have posted a question on that thread asking if it was possible to obtain an AP while in India. If it is possible then I can go to Delhi, get my unstamped passport (they did say I could do that when I interviewed with them), and go to US. And when my security clearance is done, all I will have to do is fedex it to VFS in delhi. Let me know if you have any idea about this stuff.
