I am currently on H1B visa and I want to switch the company. New company is not willing to do H1B transfer and want me to work on EAD. I have pending I485 EB3 ROW with priority date of March 2006. Its been more than 180 days that I filed for I485 so I can use AC21 with EAD.
But my question is how risky will it be if I switch job at this stage with EAD?

I believe that this is a bit more complex issue and depends a lot on several specific details of your case. At times this is very safe to do and at other times it is "no no". At times it is advisable to inform USCIS and at other times not. It all depends on several specific factors (specifics of your case: details of LC, job title, duties, classification, salary, location etc etc).
Bottom line: Can't get/give answer on the forum. Definitely worth consulting a VERY GOOD attorney.

Copanies like INFOSYS are not the culprits. This is going tangenatially. It is the local small desi body shops that suck blood and hold candidates life in their hand because of GC. They should be investigated.
I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...
Wish there is a different category of visas for outsourced kind of work so that H1s can be used by America based companies and H1 is not seen in such a bad light.

Hi Shamu,
A colleague/friend of mine and his wife decided to have a home delivery. So, they contacted this nurse practitioner/midwife, who used to come to his home once a month and do all the stuff that goes along with pregnancy. They also delivered the baby at his home, which took off all the expense that are associated with a hospital delivery and I'm pretty sure the entire cost for the 9 month term was <5K (actually around 2-3K).
But I believe that was possible because it was a normal delivery with no complications.
So, if you and your wife are in the same situation as most of the people here (i.e. late 20's or early to mid 30's ) there is no reason why you would not have a normal uncomplicated delivery. So having a home delivery is an option.
I am a father of a 15 month old and felt that most of the months that we went to visit the doctor was pretty superficial. They did not tell us anything which you cannot find out from the internet or the maternity books. Who delivered my daughter in the hospital? Well a nurse did.
Also in India my wife told me that most often women don't go to the doctor unless there are issues. (For the period leading up to the delivery. For delivery they go to the doctor.)
So, for uncomplicated deliveries a home delivery could be an option, just check it out and the nurse practitioners (OBGYN variety)/midwives are fully qualified and sometimes more experienced than the doctors as that is ALL they do, they deliver babies.
So check this option if you feel it is OK.

Then changed employer with AC21 who does not have insurance, so bought individual insurance. Until now I have not realized that being in a group insurance is such a great benefit. But I am exploring options and I expect some thing will come out.
I am not yet under panic mode and have so many good frineds at IV. That is a great moral support, at least I believe.

if there is an interview scheduled for you in the future, you will have to prove the intention that you will leave the job you have at that time and start working for the company who sponsored for your I-485.
it will take strong persuasion to convince that leaving your current job cold turkey and going back to the old employer.
i hope someone who has gone through this before can help you better...
also, you have to think about the cooperation that you are counting on from the old company. people come and people go.policies change, companies may decide to act differently 3 years from now... what guarantee you have that they will support you no matter what happens in future. what if there is a hideous RFE and they chicken out???
i think it is always better to declare your change of job intention with AC21. get help from other threads and furnish as much information to USCIS as possible while writing AC21 letter...they will treat you better if you are upfront about it... remember, complete transparency always is appreciated by a fellow human being...dont be scared by the conspiracy theorist blaming them for blatant mistakes...they do make mistakes however, but it just takes following it up and clearing it with various avenues one has if he/she gets the right consul of a good attorney...(incidentally i am not one....so please consult with your attorney before taking any steps)

those numbers.... 60% or 90% are all doctored...... and i'll look at the poll numbers only if both the following conditions are true -
1.) if i've no brain of my own to differentiate between right or wrong, so i must rely on the poll numbers to help me choose my position
2.) if i'm a cheap bastard running to get elected in some useless office ..... therefore i must do what is popular than what is right.... i must give up my conscience and i must choose my position looking at the poll numbers......

This situation may happen for many people. Now EB2 persons need to prepare for this situation because of PD movement. Also EB3 people also need to prepare for this situation in case recapture bill is passed. For chances of passing recapture bill is 50% and if it is passed it will be swift and fast.

The anchor started off the interview by making a reference to "hi tech workers" and that some of these folks were in the British terror plot !! "Why are you filing the lawsuit when your client can apply for the GC in Oct?" !!Anyway, the attorney was quite articulate in explaining the issue. Guess who followed the attorney ... Are you sure he is not going to mess up ur case because u filed using a different law firm against his wishes.
You only can answer the above question. If u think there is a possibilty that he will mess it up, Dont go with a different law firm.
Talk to him and see what he needs.
I do have copy of labor approval but I donot have copy of job description that they filed for labor. I also have copy of 140 approval.
I don't think I can get letters from HR (there are couple of people who handles everything from getting timesheets to posting payslips) as they very loyal to my employer.
Then I guess my only options are
- give it a try to file through another attorney with paystubs and without employer letter.
- forget about $5000 and proceed.

Could you please post who did the education evaluation for you? Was it a course by course eval?
It will also help if you could provide details on your labor certification category such as
section (203) (3) (i) or (ii) etc.. for skilled worker or professional. I believe You could also find this on your I-140 receipt notice..
'Will accept academic studies evaluated as equivalent of US Bachelors' This wording is tough to handle given that what you have is a Combination of courses evaluated as equivalent to US Bachelors, based on details provided in your post quote "I have a 3 year diploma & 1 year towards Bachelors in business" end quote.

Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this unfair policy and reinforce that America is truly a society that celebrates meritocracy.

Employer letter is not required if you are attaching photocopies of two current pay stubs.

You would need employee letter as well. The employee letter will state that the position is still open and they are willing the pay the amount that was initially agreed to while filing for labor.....so pay stub is not enough.....

I have my TX license till 06-2013. With the new rules, I heard that DMV's in Dallas are issuing vertical cards which has an expiration date of EAD/H1b expiry date. I recently moved to a new apartment. When i try to change the address online it is asking me to go the nearest DMV. I dont want to loose my current license which has expiry till 2013. Is it OK if i dont change my new address on my drivers license or is there a way to get my new card with the old expiration date. my current EAD expires on 10/2009.
