    Right, but that A# I found on my H1b approval (approved Oct 10 '07) is different from the A # in my 458 receipts.

    Just trying to figure out if folks who had an A# in the H1b approval notice are also facing the PIMS delay. (just a wild guess).

    in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!

    NOT SURE WHY ?? this delay is ??

    i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

    It is simply crazy of USCIS, but it is not beyond commonsense for us to realize that the notice was mailed in last few hours of the previous FY, so there might have been those hiccups between USCIS and DoS systems releasing the last few visa numbers.

    Understand that you might well be current for this FY but the notice was generated in September. So now you should do your best to make sure your file is not relegated under a big heap somewhere... as others so rightly suggest, the congressperson route should serve well.

    I recieved 2 notices in mail today.

    One is the welcome notices which says that I-485 is approved.
    Another notice which says that they reviewing or reconsidering the decision previously taken.

    Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.

    How can that be when am current in oct as well.

    Mine is EB2 and the priority date is Dec 2004.

    Any suggestions to have this fixed.

    According to IV Tracker, his EB2 PD is Nov 2005. He has filed in Nebraska.

    Why is this a risk? We are doing what we are supposed to do. Send packages based on our dates being current. If USCIS/DOS screws the dates we slap them with a law suit.

    After such mad rush and bad news about visa bulletin revision? How many are considering to file on July 2nd and July 3rd? What is the general advice regarding filing from lawyers and oneself about sending documents on July 2nd and July 3rd?

    My lawyer is sending through FedEx - overnight delivery - going there on July 3rd. My worry - Is it a huge risk on my part? What happens if Monday morning it is revised, or worst Tuesday it is revised?

    How many are risking on this??

    But, can somebody answer my question above..........why is the same house (not even a brick changed) being appraised at around 100k lower than it was done 2 years back, by the same bank??

    For the same reason S&P500 shares which used to be something like $130-140 couple of months back are now selling for $85. Now should I go blaming NYSE/NASDAQ for that and ask my money back?

    Buying house is not much different than buying stocks - both of them are investments at the most fundamental level and are hence susceptible to ups and downs. If you don't have stomach for it just don't do it.

    Now, if you say you don't treat your home as investment but as a place to live then you should not be bothered if your house value is down temporarily in the short term. You can still live in it.

    The very first post in the thread says the poster hoped to sell it off in two years and pocket a quick profit. Nothing wrong with that but it's called speculation and every speculation carries a certain risk with it. Own up to that risk! There is no investment with only upside. That's the very basic tenet of investment.

    I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.

    For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.

    There is no number to call here to check on status - I have been sending emails to mumbaiNIV@state.gov but have not received any response from them yet. Not really a surprise. If anyone tries the number above and gets some response please let the rest of us know.

    Has anyone done this? We need to go to Chennai embassy for a first time L1 stamping in a few months. If I can do this from here, that will really help.

    Any help is appreciated.

    Now as per my lawyer's advice probably we will need to change her status back to H4.

    Do you know how much time it will take to get that status change? What if your PD is no longer current?

    Guys:
    Here is my scenario :

    We have a 3 year extension( H1-B for myself) and (H4 for my wife) based on an approved I-140 valid till Feb'2010.

    I am going to apply for I-485(both) next month and EAD for my wife.

    My questions are :

    A) Do I need to apply for EAD for myself ? If yes, what are the benefits ? Does it help to have an EAD, if I decide to change jobs using AC21 after 180 days of filing I-485 ? Or any other benefit ?

    B) Do I need to apply for AP for both me and my wife ? Can't we travel and then get Visa stamped for 3 years (till 2010) based on the I-797 that I have ?
    Do we have to use AP only if we want to travel, once we have filed I-485 ?

    Why this is the news is good and relevant from the point of view EB provisions?

    Because EB provisions (section 8001) were thrown out of S.1932 because of the differences between key players over the Patriot act. Now that this is out of the picture, at least there is one less thing to worry about.

    It is not too late to write the letter, it is never too late to write the letter!!

    Since the letters are only requesting fixing of the interpretation of the law, and not the law itself, there really is no fixed deadlines involved. Of course, sooner it is done, the better our chances are for moving forward.

    How long does it take to receive RFE letter by mail? Can we get a copy of RFE letter at the InfoPass appointment. I don't have patience anymore to wait. At least they can tell us what the RFE is about on the phone. These guys are trying my patience.

    I dont get this - the PDF clearly mentions that the table is for ALL PENDING EMPLOYMENT-BASED 485s. So that means: -
    1. It does not include any Family-based 485s.
    2. This is not a count of just pre-adjudicated cases - this is a count of ALL PENDING CASES.
    3. And since this is a count of ALL PENDING CASES, it also means that ALL DEPENDENT CASES are also included in this count - all DEPENDENTS HAVE TO FILE THEIR OWN 485s!

    Sometimes I just wonder, if most people here on this board have an illness or over-analyzing everything. It is so simple if you just read what is stated and take it at the face!

    The only thing I can tell is most of us are trying to search "light" from this "black and dark cloud". USCIS does not seem to be agree with what you are saying. Please have this trend chart and the worksheet in this thread together and then you will realize what we all are saying.:)

    If they were submitted on 8/30/ and it's not cleared yet and your derivatives are cleared then more than likely you are stucked, there is some probability that you might be cleared in few weeks depending on number of hits generated against your name and avaialibility of the documents needed to be refered by fbi to clear you. However you dont need to worry much because now a days fbi seems to getting work lot faster then it used to. Also since july fbi has increased the fees that they charge USCIS to do the check which has increased the staff at NNCP and so the efficiency. I would suggest for you to wait 60 days and try again. Hopefully you have good news. I have been waiting 35 months.

    After filing I-485 one single thing which gives butter-flies is NC. Just a Look at your and CAdude posting shows how terrible is NC and how difficult it is for those unlucky ones to bear this uncertainty. God bless all !!!

    Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.
